According to the provisions of art. 13 of Legislative Decree 196/2003 ("privacy code"), Termotecnica Pericoli Srl, based in Albenga, in Regione Rapalline, n. 44, (17031), the data controller, (indicated as “Owner” or “Termotecnica Pericoli”), provides users who wish to subscribe to the newsletter service with some information relating to the processing of the acquired data.
What data is processed and for what purposes
The identification data (name, surname and email address) provided by the user through the specific form are used to allow the user to subscribe to the newsletter service and receive messages of commercial and promotional content sent by the owner to the subscribers, through the Infinity platform offered by Zucchetti (click here for cookie information)
The user is also informed that the platform used by the owner to manage the newsletter service allows, through statistical tracking systems, to detect some information (such as opening a message, clicks made on the hyperlinks contained within of the email and other similar details), whose collection is functional to the use of the platform and is an integral part of the functionality of the system for sending messages.
Communication and dissemination
The data collected will not be disclosed. The data will not be communicated to third parties without the express consent of the interested party, without prejudice to the hypotheses in which the communication to third parties (competent Authorities, consultants or companies that provide IT supply and assistance services, company providing management platform and sending of emails) is necessary to fulfill legal obligations or to fulfill the obligations deriving from the existing relationship with the interested party or third parties (falling into one of the categories indicated) operate as privacy managers.
Data processing methods
The data collected is processed through the platform and IT tools offered by the Zucchetti Infinity service as well as through additional IT tools used by the Data Controller for managing the service adhered to. No transfer is made to countries outside the EU of data acquired and managed for the service offered.
The data is stored up to the request of the interested party of possible opposition to the sending and the will of these to renounce the receipt of the newsletter and in any case no more than two years from the registration of the personal data themselves.
Rights of the interested party
The interested party may assert at any time, without formalities, by contacting the data controller, also by sending an email to the address firstname.lastname@example.org, the rights referred to in art. 7 of Legislative Decree 30 June 2003 n. 196, which is shown below textually. 1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet recorded, and their communication in intelligible form.
2. The interested party has the right to obtain the indication: a) the origin of personal data; b) the purposes and methods of processing; c) the logic applied in the case of processing carried out with the aid of electronic instruments; d) of the identification data concerning the data controller, data processors and the representative designated pursuant to Article 5, paragraph 2; e) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or appointees.
3. The interested party has the right to obtain: a) updating, rectification or, when interested, integration of data; b) the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including data which does not need to be kept for the purposes for which the data was collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the event that such fulfillment occurs it proves impossible or involves a manifestly disproportionate use of resources with respect to the protected right.
4. The interested party has the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning him for the purpose of sending advertising materials or direct sales or for carrying out market research or commercial communication. Data controller The Data Controller is Termotecnica Pericoli Srl. The provider of the platform used for the newsletter service operates as a privacy officer. The interested party may request the list of appointed privacy officers from the Data Controller. Nature of data provision and consent The provision of data is optional. Any refusal will make it impossible for the holder to reply to the requests made by the interested party.
According to the articles 23, 122 and 130 of the privacy code, consent to the processing of data is necessary as they are used for sending commercial and promotional email according to the methods described in this statement and for access to information through the systems offered from the platform used by the owner.
